Bayview Crematory Shut Down In February June 30, 2005
HAMPTON, N.H. -- Three people have been arrested in connection with the Seabrook, N.H., crematorium, where officials claim several remains were mishandled.
NewsCenter 5's Jack Harper reported that James Fuller, who was in charge of the day-to-day operations at Bayview, is charged with abuse of a corpse and fraudulent handling of documents. The crematory's owner, Derek Wallace, was arraigned on charges including abuse of a corpse and theft Thursday afternoon.
"The theft charges are taking funds from families, certifying that they are going to conduct these cremations legally and they are not being done legally, they are being done without proper documentation, they are being done, sometimes, without permission from family members," said Rockingham County Attorney James Reams.
"It is what we expected. (Wallace) is delighted that the battle has been joined because now he gets an opportunity to respond in a forum that will be equally as public as the prior forums have been that were exclusive to him," said defense attorney Scott Gleason.
The Bayview Crematory was shut down in February for operating without a license and allegedly mishandling and co-mingling remains.
Dr. Putman Breed, a Massachusetts district medical examiner and a surgeon at the Anna Jaques Hospital in Newburyport, Mass., also faces charges. Prosecutors say Breed signed documents approving cremations in New Hampshire without proper authority.
"Dr. Breed is charged with falsifying documents concerning cremations that occurred here in New Hampshire a the Bayview Crematorium. There are theft charges against Derek Wallace, there are theft charges against the doctor and falsifying other documents here in New Hampshire," said Reams.
"(Breed) is very surprised by all this. We hope to resolve it in a way that is amicable," said defense attorney Ryan Russman.
As the founder of the crematorium, prosecutors consider Wallace the main player in their case. Since February, Wallace has transferred ownership of the business to relatives. He was freed on personal recognizance.
Prosecutors said more charges could be filed in the ongoing investigation.
Meanwhile in Boston, NewsCenter 5's Amalia Barreda reported that the crematory controversy has stretched to Harvard Medical School, which was named in a major lawsuit connected to Bayview Thursday.
Betty Fronteiro, 75, of Gloucester, Mass., died in February 2004, two weeks after she was diagnosed with liver cancer. Her final wish was to donate her body to the anatomical gifts program at Harvard Medical School.
"Her words were, 'Just think -- I'm the one in the family that applied to Harvard and got accepted.' And so we were ecstatic. She was happy and she died knowing that," said Geraldine Favaloro, Fronteiro's daughter.
Exactly one year later, Favaloro said she was horrified to learn Harvard sent her mother's body to the Bayview Crematory in New Hampshire. The facility, shut down for operating without a license, has been the focus of a scandal alleging remains have been mishandled and co-mingled.
"They took her, my most precious possession. And I'm not sure I even have her back," she said.
A lawsuit filed by Favaloro Thursday morning against Harvard alleges the medical school should have known Bayview was not a legitimate operation.
"Obviously, Harvard should have known better. Harvard should have been dealing with reputable approved Massachusetts-based crematories that have impeccable reputations. Unfortunately, they did not," said attorney David Charlip.
"My mother would be horrified because it was her proudest moment," said Favaloro.
The school released a statement Thursday that read, "Harvard Medical School is very concerned by the published reports about the alleged practices at Bayview Crematory. The school did not contract directly with Bayview and Bayview is no longer used."
