Judge bars mortuary from doing business in Rohnert Park PDF Print E-mail

SANTA ROSA, CA

A Sonoma County judge on Monday prohibited a mortuary accused of storing decomposing bodies in a rented warehouse from doing any more funeral-related business. Judge Allan D. Hardcastle granted the preliminary injunction sought by the city of Rohnert Park to prevent the owner of Abby Chapel of the Redwoods from operating, pending a May 10 hearing.
City officials allege that Anthony Villeggiante operated the funeral parlor without a valid business license and did not have a permit for storing bodies off-site. Inspectors found nine decomposing bodies in the warehouse, which was refrigerated by a swamp cooler, after neighboring businesses complained of a foul odor earlier this month.

The injunction also bars Villeggiante or any associates of Abby Chapel from keeping bodies in Rohnert Park.

The judge said Villeggiante, who does a lot of work helping Mexican immigrants get relatives' remains sent south for burial, could resume using his business office “to arrange funerals or related activities outside the City of Rohnert Park” if he applies for and receives the proper license.

Villeggiante's attorney, Michael Fiumara, said he considered Monday's order a “victory” because the judge “didn't shut him down completely.”

Fiumara said Villeggiante maintains that he didn't need a conditional use permit to operate and is now considering moving his business to a part of the city where a permit would not be required.
