Board fines Columbus funeral home delay in cremation PDF Print E-mail

JACKSON, Miss. - The state Board of Funeral Services has fined and placed on probation a Columbus funeral home for keeping a man's body for nearly five months even though family members had paid for his cremation. State law authorizes the board to levy fines up to $5,000 per offense. The specific fine for Carter's Funeral Services was not made public pending a formal disciplinary order.

Board chairman Charles Riles of Vicksburg said Vanessa Carter, owner of Carter's Funeral Services, waived her right to a hearing and agreed to the punishment.

George Rush died in early November. His embalmed body remained at the funeral home until late March. The state board then ordered the corpse be sent to a crematorium as the family had paid Carter to do.

"The Board of Funeral Service was very insistent that we take action on this," Riles said.

Carter has said Rush's body remained at the funeral home because she couldn't track down his two sons - both in prison - to formally approve of their father's cremation.

Carter said she could not legally release his body until documents had been properly signed and notarized by his next of kin, no matter how long it took.

The funeral home, she said, received the necessary paperwork the same week the state board came upon Rush's body in late March. The corpse was sent to a crematorium on March 31.

Riles said Carter, who could have lost her state funeral service license, and the board came to terms this week.

State law allows the funeral board to waive disciplinary hearings if the accused admits guilt. Carter won't be off the hook until she complies with the board's consent order, Riles said.

"She has to pay that fine, and she has a time period. If that is not paid, that's a bad situation," he said. "We're not going to continue this thing on and on."

Gaina Rush of Columbus, George Rush's sister, said whatever penalty was imposed on Carter would not be enough.

"A heavier fine (is needed for) the pain and suffering we went through and what she did. ... I don't think it's fair what we have gone through," she said.

George Rush, a 64-year-old former cleaning service worker, died of liver failure Nov. 4. Relatives had a memorial service and paid Carter for the cremation by Dec. 8.

After not receiving his ashes, Gaina Rush said she tried to contact Carter but got no response.

A board member went to Carter's Funeral Services to investigate in March. Rush's embalmed body was in a back room.

The Board of Funeral Service oversees the state's mortuary businesses and disciplines those who violate state regulations.
