Baby Was Evidence In Criminal Case

ATLANTIC CITY, N.J. --
A crime that shocked residents and police in Atlantic City has taken a bizarre twist. The body of a newborn was found on July 4 in the trash and the child's mother, Ashley Eberson, has been charged with killing the infant.

Now, the baby's body, an important piece of evidence in the case, has been mistakenly cremated.

Officials at Shore Memorial Hospital in Somers Point, N.J., admitted that they sent the wrong baby to be cremated.
 
The hospital leases morgue space to the Atlantic County Medical Examiner's office.

"I just don't want it to happen again to anyone," said Patricia Plummer of Mikal's Funeral Parlor.

The mistake stunned Patricia Plummer who works at Mikal's Funeral Parlor. Just days after a funeral parlor employee picked up a deceased newborn at Shore Memorial Hospital on July 20 and had him cremated, she learned it was the wrong baby.

"I just felt that was a travesty that these two babies got mixed up on a matter of paperwork," Plummer said.

Officials said the hospital accidentally released from the morgue the body of a baby found July 4 in an Atlantic City garbage can, not an infant who was born at the hospital and died of natural causes.

Eberson, 23, of Ventnor, has been charged with aggravated manslaughter. Eberson remains in jail in lieu of $500,000 bail.
Eberson's attorney, Steven Rosenfeld, learned of the mistake Monday from NBC 10 News.

"It's disturbing," Rosenfeld said.

Rosenfeld said that it is too early to predict if the error would impact the case, but because it happened after the medical examiner completed an autopsy, Rosenfeld said the mixup could impede any potential defense efforts to scrutinize the autopsy.

"It's possible that the case could be damaged to the point that it no longer is capable of being proven," Rosenfeld said.

A hospital representative said Shore Memorial deeply regretted the highly unusual error, which was the result of a miscommunication between the hospital, the medical examiners office and the funeral home. The representative said it stemmed from one of the babies being registered inconsistently at the morgue and in the hospital's admissions database.

The representative said the hospital is reviewing its internal policies and procedures and taking steps to prevent this from happening again.

Prosecutors said the autopsy was properly performed, well documented and believe the mistake would have no impact on the state's case.
