Judge Calls For Research On Cemeterys Mystery Vault PDF Print E-mail

FORT LAUDERDALE--The operators of a local cemetery have to do a little more research to identify the contents of a mystery vault before disturbing the remains inside, a Broward judge ruled Tuesday. The request comes over a month after gravediggers at Sunset Memorial Gardens at 3201 NW 19th St. in Fort Lauderdale stumbled on an unidentified vault while preparing a pre-paid burial plot designated for housekeeper Cora Bell Jackson.

Jackson, who grew up in Douglas, Ga., but came to Fort Lauderdale in her 20s, died more than a month ago at the age of 81. Jackson's body was kept frozen for 35 days at the Roy Mizell & Kurtz Funeral Home after gravediggers discovered that her plot, next to that of her late daughter, Shirley, was already occupied.

The operators, CFS Funeral Services, a subsidiary of Carriage Services Inc. of Houston, say they hope to identify and respectfully relocate the remains to make room for Jackson.

In the meantime, Jackson's body was temporarily interred in a mausoleum at Sunset on Friday.

Circuit Judge Patti Henning said she would reconsider CFS' request on Thursday. It is illegal under Florida law to disturb human remains without state authorization.

Meanwhile, Henning said she will appoint a courtroom advocate to look after the interests of remains contained in the vault.

Georgia Robinson, a lawyer representing the Jacksons, said the family has filed a complaint against Sunset with the state.

''It raises questions about the management,'' Robinson said outside the courtroom, adding she knew of at least four breaches of contract between plot-holders and the company, including cases in which occupied plots were mistakenly sold to new customers.

CFS has said the Jackson incident was the first such problem at Sunset.

The Houston-based company took over operations of Sunset and those of two other city cemeteries, Lauderdale Memorial Park and Evergreen Cemetery, in 1993. Two different companies have run Sunset in the past. It's still unclear who was in charge when Jackson's plots were purchased.

Robinson said Tuesday that she believes Sunset was not as well-kept up as the grounds at Lauderdale and Evergreen, something she attributes to Sunset catering predominantly to African-Americans.

Chris Schaeper, an attorney for Carriage Services, said the allegation was simply not true.

As for solving the Jackson plot dilemma, he said the company hopes to acts as ``quickly under the circumstances as possible.''
