A funeral home director targeted in the investigation of a ring that plundered the corpses of Masterpiece Theatre host Alistair Cooke and other people for body parts has agreed to cooperate with authorities, another defendant's lawyer said yesterday.

Mario Gallucci, attorney for alleged ringleader Michael Mastromarino, said after a pretrial hearing that he had information that Timothy O'Brien had cut a deal with prosecutors to testify against his client. O'Brien was director of New York Mortuary Service Inc., the Manhattan funeral parlor that handled Cooke's body in 2004.

"I understand that he was charged in a sealed indictment, and that he signed a cooperation agreement," Gallucci said.

The Brooklyn District Attorney's Office and O'Brien's lawyer declined to comment.

A law enforcement official later confirmed that O'Brien was cooperating. The official spoke on condition of anonymity because the investigation has not been completed.

Authorities had been investigating whether O'Brien and Mastromarino conspired to take tissue from people who had not given consent or were too old or too sick to donate - an allegation both denied. The tissue, typically skin, bone and tendons, was sold for use in a variety of common procedures, such as dental implants and hip replacements.

Mastromarino and three other defendants pleaded not guilty in February to charges including body stealing, unlawful dissection and forgery.

The ring allegedly removed parts from hundreds of bodies from funeral parlors in New York, Rochester, Philadelphia and New Jersey. Authorities said Mastromarino had made millions selling the parts to biomedical supply companies.

Investigators unearthed evidence that death certificates and other paperwork had been doctored. In Cooke's case, his age was put down as 85 rather than 95, and the cause of death was listed as a heart attack instead of lung cancer that had spread to his bones.
