SEABROOK - Two former deputy assistant medical examiners who are being investigated for alleged irregularities in reporting cremations at the Bayview Crematory in Seabrook, have been indicted on charges of falsifying cremation certificates at two other funeral homes.
Gene Nigro, 47, whose address in the indictment is listed at 31 Prescott Road, Raymond, but who reportedly now lives in Exeter, was indicted by the Rockingham County grand jury on Friday on five counts of fraudulent handling of recordable writing, Class B felonies.
He allegedly provided signed cremation certificates to the Douglas & Johnson Funeral Home in Salem when he had not viewed the remains on five occasions between January and May 2004.
Kathrine Wieder, 50, of 155 Low St., Newburyport, Mass., the former chief forensic investigator for the state, allegedly falsified cremation certifications when she had not reviewed the remains.
She was indicted on two counts of fraudulent handling of recordable writing, involving a cremation at the Southern New Hampshire Crematory Inc. in Derry in August 2004, and another cremation at an unidentified location in Derry in September 2004.
Three indictments for criminal solicitation allege Wieder requested Eric and/or Craig Peabody, doing business as the Southern New Hampshire Crematory, Inc., to use a pre-signed cremation certificate and to begin cremation when she had not viewed the remains.
An indictment of official oppression alleges Wieder, to benefit herself and a select few assistant deputy medical examiners, instructed funeral homes and crematories to use only certain examiners, "thereby increasing the potential number of fees that would be collected by Wieder."
Assistant deputy medical examiners work on a freelance basis, receiving $35 to view bodies and to sign the cremation certificates.
Wieder allegedly collected at least $20,000 in one year by falsifying cremation documents and tightly controlling the certification of New Hampshire cremations, according to information obtained by the Newburyport Daily News.
On Friday, a Newburyport District Court judge agreed to release sealed affidavits and an October search warrant for Wieder’s home, according to the newspaper.
The official oppression and criminal solicitation charges against Wieder are Class A misdemeanors while fraudulent handling of recordable writing is a Class B felony.
None of the indictments released by the Rockingham County Superior Court involve the Bayview Crematory in Seabrook, which state police and the county attorney searched last month in an effort to gain further information on Nigro.
They shut down the crematory after finding Bayview had been operating since 1999 without having been registered or inspected by the state.
Investigators there on a search warrant found a decomposing body, which had been stored in a refrigerated unit that was broken.
State police and County Attorney Jim Reams are investigating Nigro’s and Wieder’s connection to Bayview, according to the search warrant.
Reams, who could not be reached for comment on Monday, is expected to release further information in a press conference scheduled for today at 2 p.m. at the Seabrook Police Department.
