July 13, 2004 Jean Cane lost her mother over the weekend to terminal illness.

The plot where her mother is to be laid to rest is at the Whitney Memorial Park Cemetery in Bosque County, problem is, Cane hired a funeral home out of Hillsboro to take care of the funeral arrangements, which included the burial, mainly because she felt they gave her the best deal. She says she had no idea the trouble the decision would cause.

"This is too much, I've lost my mother and all I want to do is get my mother in the ground and I don't want all these problems, " Cane said.

Cane's father was buried in the same cemetery several years ago. Her mother's plot adjoins his.

Not long before her mother died, Cane says she learned that the only funeral home with rights to dig the graves at the Whitney Cemetery is Marshall and Marshall Funeral Home in Whitney, about one mile up the road.

"I said if you force me to do this I'll hire a lawyer, do whatever I have to do, " said Cane.

Whitney Memorial Park is governed by a local association, Sue Brooks is the president.

She would not talk to us on camera, but did give us a copy of the agreement between Whitney Memorial Park and Marshall and Marshall Funeral home.

The agreement, which was signed in 1993 states that the association grants Marshall and Marshall the exclusive right to open and close all graves in the Whitney cemetery.

Marshall and Marshall director, James Shaw says the agreement is in exchange for certain cemetery maintenance Marshall and Marshall provides.

"As far as I know everything is legal between us and the cemetary," Shaw said.

In order for Cane to bury her mother the legal way, according to the agreement, she would have to pay Marshall and Marshall a fee on top of what she's already paid the funeral home she hired.

Instead, she's going on with her mother's funeral her way and Cornerstone Funeral Home out of Hillsboro has agreed to go ahead and dig the grave, without the proper permission.

"After this particular case, we will pursue the legal aspect and see if what they are doing is wrong, " said Cornerstone Funeral Home Director, Kirby Edens.

Cane says she plans on filing a formal complaint with the Texas Attorney General's office once her mother is finally buried and Cemetery officials say they plan to look into some sort of legal action too.

The Attorney General's office wouldn't comment on the case but referred us to the rules that appear to give associations the right to set restrictions and reasonable rules for the operations of cemeteries.
