Family wins $120,000 from funeral director PDF Print E-mail

DAYTONA BEACH -- A jury has ruled that a former funeral director failed to embalm a Port Orange man and awarded the family $120,000.
The jury's decision Thursday came at the conclusion of a two-day civil trial in circuit court.

Two years ago, John Rister, 44, pleaded no contest to charges he accepted $395 in September 1999 to embalm 27-year-old Wayne "Scotty" Wilcox but never did the job. Rister served as funeral home director at the troubled Bellevue cemeteries.

Investigators targeted the owners and operators of the Bellevue cemeteries for botched burials, dumping of biohazardous waste and taking gold teeth from corpses. Cemetery owner Willard Timmer agreed in 2001 to pay $1.2 million in fines and state costs and relinquish control of his Florida death-care businesses.

An attorney for the Wilcox family said the $120,000 award will be paid from funds the Timmer family paid the state.
