MEMPHIS,TN - If justice is blind the 13 thousand people who bought pre-need funerals years ago, hope a jury will see things their way. Class Action lawsuits are underway. Sharron Dollar's mother joined in one of the lawsuits. Dollar says, "I don't believe they would find in favor of money hungry corporation who's trying to do older people out of what little they've got left."


Dollar's 83 year old mother, Elizabeth Harris, paid for her funeral at Forest Hill Funeral Home years ago. She hopes to be buried next to her husband. Now the new owner isn't honoring old policies so she may have to pay thousands more. She's joining a class action lawsuit. "It looked like the only course we had. I didn't know what else to do,"says Harris.


Lawyers filed the first class action lawsuit against Forest HIll Wednesday. Husband and wife, David and Dianne camp of Mississippi are suing on behalf of themselves and all other persons similarly situated. Germantown Lawyer Kevin Snider also has a class action lawsuit in the works. He says any of the 13,000 people affected can automatically join. Snider says, "Our lawsuit or their lawsuit or both the lawsuit would represent everybody that wants to be a part of the class."

A judge must certify the case warrants class action status first. Based on the number of people affected lawyers don't believe that will be difficult. By telephone the owner of Forest Hill, Clayton Smart said he had no comment about the lawsuit. He said he hasn't read it but he plans to make an "earth crashing announcement" about the pre-need funerals in a couple of weeks.


Those joining the suit wouldn't pay up-front fees. In the end, lawyers say the suit may end up involving tens of millions of dollars. If they win, that's big help for the policy holders and as usual in class action cases, a big pay day for the lawyers.
