Quincy funeral home sued over treatment of two bodies |

A Braintree lawyer filed lawsuits today claiming that a Quincy funeral home and a New Hampshire crematory mishandled the corpses of a Quincy man and woman.
Two plaintiffs filed complaints in Norfolk Superior Court against Hamel, Wickens & Troupe Funeral Home, the Cremation Society of Massachusetts and Bayview Crematory, a spokeswoman for attorney Mark J. Gladstone said.
Maura Richards, a spokeswoman for Gladstone, said the lawsuits were filed on behalf of Marion Knudsen, of Quincy, the widow of Roger P. ‘‘Mike'' Knudsen, and Josephine ‘‘Pat'' Harrison, of Quincy, daughter of Myrtle Quigley-Duato, of Quincy. The funeral home handled the remains of both Knudsen and Quigley-Duato.
John Boyle, the lawyer representing Hamel, Wickens & Troupe, said he had not received copies of the lawsuits but that in correspondence with Gladstone last month, Boyle told him that the funeral home was not responsible for the operations of Bayview.
‘‘Bayview Crematorium is an outside vendor used by a number of funeral homes,'' Boyle said. ‘‘Nobody in the industry had any indication there was any issue with Bayview.''
Marion Knudsen could not be reached yesterday.
Roger Knudsen, 63, died on Aug. 10, 2001. He was commodore of Quincy Yacht Club and worked as a radio technician for Tandy Corp. in Hingham.
New Hampshire authorities raided Bayview in February and said they found two bodies being cremated in the same oven, unlabeled urns of ashes and a decomposing corpse in a broken cooler. The crematory was not licensed, officials said.
New Hampshire investigators have said they cannot guarantee that families received the right remains.
Roger Hamel has previously said he sent about 150 bodies a year, 60 percent of his cremation business, to Bayview, and that he knew of no problems there. He said he made several unannounced visits to the crematory every year.
Hamel, Wickens & Troupe was also named in an Essex County lawsuit filed last week against 11 funeral homes in Massachusetts and Bayview. The suit by 36 Massachusetts families seeks damages for emotional distress.
The Rockingham County attorney is investigating the crematory. Last week, New Hampshire authorities searched funeral homes in Lawrence and Salisbury and funeral homes in Salisbury belonging to Linda Stokes, owner of the Bayview property and former owner Derek Wallace.
They were seeking financial records that ‘‘would indicate control and ownership'' of the Bayview Crematory, as well as the relationship between the crematory and the funeral homes, the county attorney said. Neither Stokes nor Wallace has been charged with any crime.
The Cremation Society of Massachusetts, a for-profit corporation, operates at the same Quincy address, 26 Adams St., as Hamel, Wickens & Troupe, its web site says.
