Daniel Wozniak says a relative was buried in his plot without his permission.

WILKES-BARRE – A Dupont man wants a church to exhume a body it buried in a cemetery plot he says he owns. Daniel Wozniak, of Coolidge Street, filed a lawsuit Tuesday against the Sacred Heart of Jesus Roman Catholic Church, asking a judge to force the church to remove the body.
According to the suit filed in Luzerne County Court of Common Pleas and Wozniak’s attorney, Michael Butera:

Wozniak bought three cemetery plots from the Lackawanna Avenue church in Dupont in 1985.

Wozniak used one of the plots shortly after the purchase.

But sometime in October 2003, church officials, “without permission and against the wishes of” Wozniak, buried a relative of Wozniak in one of the two remaining plots.

The church claimed it used the plot because the person belonged to Wozniak’s family. Wozniak, though, did not want the person buried in the plot because there had been some “friction” in the family.

Wozniak repeatedly asked the church to remove the body from the plot, because he “has plans” for the plots. Those plans cannot be carried out while the body is in the plot.

Now, Wozniak wants a judge to order the church to remove the body and pay him attorney’s fees.

“Danny knows the person they put in there,” Butera said. “The church was not authorized to put that person there. He wanted to use it for someone else.”

Butera said it doesn’t matter whether a relative or stranger was buried in the plot because the church used the plot without Wozniak’s authorization.

“We’ve been trying to talk to (the church), trying to work this out amicably,” Butera said. “But the church, in typical fashion, is ignoring us.”

The pastor of the church said he had not yet seen the suit and could not comment.

Bill Genello, spokesman for the Diocese of Scranton, said the diocese does not comment on pending litigation.

Wozniak could be reached for comment Wednesday.
