State official accuses church of underfunding cemeteries

BOSTON, MA --Secretary of State William Galvin says the Boston Archdiocese is violating state law by not maintaining a fund for cemetery upkeep.
Galvin accuses archdiocese of diverting money from cemetery care to other things, The Boston Globe reports.

In a 33-page complaint, Galvin alleges the Catholic Church is betraying members because people buying plots are told that 10 percent of the price will go to a maintenance fund.

According to state law, anyone operating a cemetery must have a trust fund solely for the perpetual care of the graveyard.

Chancellor David W. Smith, the archdiocese's chief financial officer, told The Globe on Wednesday that he hadn't reviewed the complaint. But he said the perpetual care law doesn't apply to archdiocese because its cemeteries predate the law.

Galvin disputes the church's exemption.

"The church is not above the law," he told The Globe.

Smith said that the archdiocese still follows the intent of the law and keeps funds for cemetery care.

Galvin's complaint will be evaluated by an independent hearing officer. In it, he asks that the archdiocese be required to set up a separate account for cemetery care and provide a public accounting of the fund.

About 500,000 people are buried in the Boston Archdiocese's cemeteries. The organization has about $17 million for cemetery care.
