Attorney says town can remove mausoleum PDF Print E-mail

The town of Elizabethtown can proceed with demolishing an unused mausoleum without fear of lawsuits, an attorney says. In a letter to the Elizabethtown Town Council January 4, Town Attorney Goldston Womble told the council that any legal action from plot owners in the mausoleum would be directed at the original builder, rather than the town.

"It appears to me that any of the individuals who may have purchased crypts no longer have a claim against the town of Elizabethtown," Womble said in the letter.

The town has been examining demolishing the structure since last year. The mausoleum was originally developed as a private concern. The management company went bankrupt and the town seized the mausoleum for unpaid taxes in 1990.

An unknown number of vaults in the structure were sold, but only one was in use in recent years. The property has become attractive to vandals and vagrants, and the town board voted last spring to demolish the structure.

Four County Electric Membership Cooperative, which owns property adjacent to the mausoleum, wants to lease the site to provide better access to the cooperative's pole yard and maintenance facility.

Any remains found in the mausoleum will be removed to plots in the town cemetery. Only one grave was known to be filled last year, although at least three spaces were sold before the developer went out of business.

A demolition date has not been set. The plans were delayed while owner of individual crypts were contacted.

The mausoleum is at the corner of Queen and Lower Streets by the town graveyard. The cemetery and mausoleum are managed by the Planning Office.
