BROWNSVILLE, Texas - Old graves were damaged during excavation work related to a Cameron County project, the executive director of the Texas Historical Commission said.

The graves were discovered two weeks ago when construction workers unearthed a utility line-trench on the county parking lot across from the Dancy Building, the historic courthouse that is being restored.

The excavation on a county parking lot has been halted.

"Based on the field evidence and limited archival information, it is highly probable that the human remains encountered are part of a city cemetery that was established in 1848," F. Lawrence Oaks wrote County Judge Gilberto Hinojosa on Monday.

Identified as the city's first platted cemetery, it may have been abandoned in 1850.

Oaks said perhaps as many as four graves were disturbed.

He told county officials that all utility line and any other planned construction must be postponed until an archaeologist examines the area and collects the remains.

"The county may eventually find it necessary to archeologically exhume graves before additional construction activities can proceed, but the initial archaeological findings will help us determine those needs," Oaks wrote.

The county's Commissioners Court met privately Tuesday with archaeologist John Keller regarding the work. State funding could assist.

Mark H. Denton of the state historical commission said cemeteries such as this one are unique for a city.

"The graves are of the first inhabitants of the community who died during those first two years of the existence of the community," he said in Tuesday editions of The Brownsville Herald. "That makes it unique in and of itself. It is such a rare find."

Even at our birth, death does but stand aside a little. And every day he looks towards us and muses somewhat to himself whether that day or the next he will draw nigh.
