Widower miffed over unfinished mausoleum

June 1, 2004 PALM CITY Ã¢â‚¬â€ Not even the dead can move into a new building unless it's been declared safe. Joe Gallo learned that the hard way when his wife Anne died March 11, and he prepared to put her in the casket and mausoleum space for which they paid $17,000 four years ago. Gallo said the problem arose as he made funeral arrangements at Forest Hills Memorial Park in Palm City and was told his wife's casket would be placed in a mausoleum that was still under construction. "They said, 'Well, six weeks or eight weeks at the most' they would be finished," Gallo said. The funeral home offered temporary space in another, older mausoleum at no charge, and Gallo put his wife's casket there for what he was told would be a short stay. But when six weeks went by and it looked like nothing was happening at the new mausoleum, Gallo started asking what the holdup was. They told him the funeral home was waiting for a "certificate of occupancy" for the new mausoleum. "Last time I talked to them, they said, 'Well, about two or three more weeks we'll have everything set,' but they always give me a target date and then it never happens," Gallo said. Gallo said he was in construction in New York and even told the funeral home what they needed to do. "I said you don't have any railings up and you have to grade it and put sprinklers and put the sod down," Gallo said. A county building official said the last building inspection was completed Feb. 6 and a certificate of occupancy couldn't be issued until a final structural inspection was done, and that hadn't yet been requested. Gabriel Romanach, a vice president for Stuart Enterprises, which owns the funeral home, said he was aware of the situation and was trying to find out why there's been a delay. "My understanding is we're probably at the point we can ask for the final inspection ... and then the certificate of occupancy. We've got to put in some minor landscaping, some irrigation. I'm hoping that should not hold up our certificate," Romanach said. Gallo said he would be happy if the funeral home would just give him a "real date" for placing his wife's casket in the mausoleum. "They said, 'Well, we're trying, we're doing the best we can.' I also wrote a letter. I got a letter responding saying by Memorial Day we should be in, and they're still a long way from home," Gallo said. "As long as I get a target date that's going to be on the level, that's all I want," Gallo said. Romanach said he would try to get that date for Gallo, so he could put the matter to rest.
