County suing Marshes to recover cleanup costs PDF Print E-mail

Walker County is suing the estate of Ray Marsh Sr., Ray Brent Marsh, Clara Marsh and Rhames LaShea Marsh to recover the county’s expenses in the Tri-State Crematory cleanup.

"Our claim relates only to funds expended to correct the public nuisance which were not reimbursed by the Georgia Emergency Management Authority, and total approximately $2 million," Commissioner Bebe Heiskell said Thursday.

The lawsuit, filed Thursday in Walker County State Court, also names as defendants any funeral homes that sent a body to Tri-State for cremation.

Heiskell said she authorized the county’s attorney, Don Oliver, to file the lawsuit. The county hired attorneys Larry Hill of LaFayette and Warren N. Coppedge Jr. of Dalton to assist in the suit.

"We have been very sensitive to the concerns and needs of families who experienced losses at Tri-State Crematory, and for that reason we have delayed taking action until those claims and concerns have finally been addressed," Heiskell said. "We had hoped to delay taking action until all criminal matters were resolved, but we believe that further delay in filing the county’s claim would not be beneficial and would serve no real purpose."

Brent Marsh faces nearly 800 felony counts related to the discovery of 334 sets of human remains found scattered in and around the business’ property in the Noble community.
