LaFAYETTE, Ga. — The mother and sister of former Tri-State Crematory operator Brent Marsh pleaded not guilty Friday in Walker County Superior Court to charges of filing false information on a death certificate.

Clara and LaShea Marsh were indicted in February on charges that they signed as funeral directors despite being unlicensed.

Brent Marsh last year pleaded guilty to dumping more than 300 bodies on the crematory property in Noble and was sentenced to 12 years in prison.

The signings occurred in 1991 and 1993, nearly a decade before the investigation was launched at the crematory in 2002.

Ringgold attorney McCracken “Ken” Poston, who represents the Marshes, alleges Lookout Mountain Judicial Circuit District Attorney Herbert “Buzz” Franklin’s office is bowing to community pressure to convict the two women.

“This is what one must do when an overly aggressive prosecution chooses a dangerously vague and never-tested provision of the law as its weapon to gain convictions against persons who the prosecutor obviously feels need to be convicted of something, anything, in order to satisfy a frustrated interest group,” Poston said in one of several motions filed Friday in Walker County Superior Court.

Chris Arnt, the assistant district attorney handling the case, said investigators found each defendant had signed one death certificate. According to the indictments, they “willingly and knowingly (made) a false statement that (they were) a funeral director.”

“If it was no big deal, then they should have been doing it all the time,” Arnt said.
