Poston Says Buzz Franklin Should Be Removed From Marsh Case PDF Print E-mail

The attorney for Tri-State Crematory operator Brent Marsh says prosecutor Herbert "Buzz" Franklin should be removed from the case for not revealing earlier that the body of one of his cousins was found at the crematory. Attorney Ken Poston said he received a letter from prosecutor Franklin on Aug. 5 stating that he is related to Ricky Alan Huffaker, who was taken to the crematory at Noble, Ga., after he died in a Chattanooga hospital on May 18, 2000.

The body of Mr. Huffaker was identified at the crematory on Oct. 3, 2002.

Attorney Poston said Mr. Franklin included a chart showing him to be a second cousin. Mr. Poston said a study of the chart actually shows the two men to be first cousins once removed, which he said is closer kin than second cousin.

Mr. Poston said it amounts to "a serious allegation of prosecutorial misconduct" and said it gives "the appearance of impropriety."

He said Mr. Franklin has been guilty of "excessive prosecution" in the case, saying Brent Marsh faces almost 800 felony counts that could cause him to face a sentence of over 8,000 years in prison.

A hearing on the motion will be conducted by Judge James Bodiford on Thursday, Aug. 19, at 10 a.m. It will be at the Walker County Courthouse in LaFayette.
