Walker County files appeal after lawsuit against Marshes dismissed PDF Print E-mail

Walker County has filed an appeal after a judge dismissed its lawsuit against the Marsh family earlier this month in the Tri-State Crematory case. Judge William J. Smith ordered a dismissal in the lawsuit filed by Walker County against the Marsh family Oct. 4.

“Judge Smith followed the law. The law of Georgia does not permit Walker County to bring in an environmental protection claim,” said attorney Stuart James.

“I think the judge and the court made a terrible mistake of confusing the environmental protection claim with the criminal case,” said Walker County attorney Don Oliver.

James feels Walker County wanted to recover the cost of the investigation.

“They are not allowed to do that. Our position is that they were not doing a cleanup, they were investigating a crime,” James said.

Many lawsuits were filed after the discovery of uncremated bodies at the crematory in February 2002. Marsh is serving a 12-year sentence in the case.
