Custody of 9-11 remains awarded to victim's mother

PORTLAND, Maine -- A dispute between the divorced parents of a Sept. 11 victim from Maine over where their son's remains should be buried has been settled, with a judge on Thursday granting custody of the remains to the mother.

Cumberland County Probate Judge William Childs signed an arbitrator's order that the remains of Gorham native Stephen Ward be turned over to Victoria Randall and buried in a plot she bought in Portland's Evergreen Cemetery.

Ward's father, Gordon Ward, wanted the remains buried in Gorham, where his son grew up, played on the basketball team and lived most of his life. Gordon Ward said his son had no connection to Portland or Evergreen Cemetery.

Stephen Ward died in the World Trade Center attack at age 33 shortly after moving to New York, where he was a bond trader. Ward worked on the 101st floor of the North Tower.

The dispute over Ward's bone fragments found at the trade center site was brought to probate court in September. Judge William Childs asked Ward's parents to see if they could resolve the dispute on their own and avoid a trial.

The two agreed to allow the matter to be settled by an arbitrator.

The referee in the case, Dana Cleaves, said in an order signed Wednesday that "the convenience and needs, including particularly the emotional needs, of the decedent's family and friends who wish to visit and pay respects at the burial site will best be met by interment at Evergreen cemetery in Portland."
